What Constitutes Negligent Driving?

If you’ve been involved in an automobile accident you might have been asked if the driver who hit you was negligent. Or perhaps you were accused of negligent driving. Either way, you’re really not sure what negligent means. And, maybe you’re wondering how the term “negligent driving” will affect your case.

Before I share with you some of the common causes of negligent driving I wanted to point out that here in Indiana every year hundreds of injuries and even deaths are a direct result of negligent drivers.

The 3 Most Common Negligent Behaviors Exhibited By Motor Vehicle Drivers

· Speeding

· Impaired Driving

· Distraction

Speeding can make vehicle crashes more likely by reducing the driver’s effective reaction time and control over their vehicle. Speed related accidents are likely to have catastrophic outcomes. Speed limits are set in hopes of improving road traffic safety and reducing the number of casualties from collisions. Speed limits may also be set to reduce vehicle noise, noise and emissions through residential communities. Driving faster than the posted speed limit regardless of the need constitutes negligent driving.

Drivers who are under the influence of alcohol, illicit drugs, over the counter medications or prescription medicines contribute to more than a quarter of traffic deaths in Indiana. Drivers who think they are immune to the effects of drugs or alcohol take the risk of injuring or killing another when they get behind the wheel.

Driver distraction such as using a cell phone, using the vehicle’s navigation system, taking your eyes off the road or even eating while driving raise the risk of a car crash. Sadly even though most States have outlawed to some extent “texting while driving” drivers persist because many do not recognize the risks involved. Even using a “hands free” feature connecting your mobile phone to your car infotainment system can take your eyes off the road long enough to cause an accident.

An auto accident can change the course of a person’s life in a split second. An injury can have a far reaching impact on an entire family if a family member is unable to work, if hospital or home nursing care is required, or if the injured person’s ability to contribute to the operation of the household is altered. We offer over thirty years of service to people who are dealing with the consequences of brain injuries, head trauma, back pain and back injuries, internal organ injuries, neck injuries (sometimes called whiplash injuries), broken bones, paralysis, fractures, tears, numbness, nerve pain, concussions, burns, disfigurement and scarring, and permanent disability and impaired ability to work.
